Der Tagungsband ist der vierte Teil der Buchreihe »Problems of Transnational Civil Procedure«. Dieser Band enthält rechtsvergleichende Betrachtungen zur Vollstreckung in Zivilsachen sowie zu einstweiligen Maßnahmen. Er basiert auf zwei internationalen Symposien in Nagoya, Japan und Padua, Italien.
Das Buch ist der vierte Band einer Reihe, die der Diskussion von Problemen transnationaler Zivilprozesse gewidmet ist. Der Band gibt die Ergebnisse zweier internationaler Symposien in Nagoya, Japan und Padua, Italien wieder. Die Symposien waren Teil eines internationalen Forschungsvorhabens über die Entwicklung von Netzwerken zur Förderung effektiver internationaler Prozessführung in Handelssachen, das von der Japanese Society for the Promotion of Science gefördert und von der Universität Nagoya in Zusammenarbeit mit der Universität Freiburg durchgeführt wurde. Die rechtsvergleichenden Beiträge des ersten Teils zur Vollstreckung in Zivilsachen befassen sich mit unterschiedlichen Vollstreckungssystemen, besonderen aktuellen Themen des Vollstreckungsrechts, der Vollstreckung bei Vorliegen nichtrichterlicher Titel sowie mit Fragen der Behandlung dinglich gesicherter Gläubiger im Falle der Insolvenz des Schuldners. Die Aufsätze des zweiten Teils werfen einen rechtsvergleichenden Blick auf einstweilige Maßnahmen. Darüber hinaus stehen Zuständigkeits- und Vollstreckungsfragen, das Verhältnis von einstweiligen Maßnahmen zu den Verfahren zur Hauptsache sowie Sonderprobleme des einstweiligen Rechtsschutz im Mittelpunkt der Ausführungen. Die Beiträge dieses Bandes befassen sich mit den nationalen Rechten Deutschlands, Englands, Finnlands, Frankreichs, Griechenlands, Italiens, Japans, Spaniens, Ungarns und der USA auf Gebieten besonderer Bedeutung für internationale Handelsstreitigkeiten.
