Die Regulierung kultureller Beziehungen im Zeitalter des geistigen Eigentums

The era of intellectual property rights is characterized by the advance and diffusion of proprietory institutions (rules) in the spheres of cognitive scientific and cultural knowledge, symbolic representations, fine arts, and media. Particular competences and claims for the usage of symbolic artefacts or intangible goods, as well as social hierarchies and processes of cultural and economic cooperation, exchange and exclusion, are increasingly regulated with reference to the cultural and legal pattern of intellectual property. In the course of a long term and cyclical process of 'propertization', proprietory practices, conventions, institutions and mentalities are widely diffused and adapted to various social constellations, economic interests, cultural contexts as well as legal and political environments. Thus, they become ambiguous, polyvalent and multifunctional. The present article starts with a short discussion of two fundamental questions of the history and sociology of knowledge, culture and law: 1) Why and how do modern societies make distinctions between 'universal', 'common' and 'particular' forms of knowledge, symbolization and expression, and between material and immaterial objects or artefacts? 2) What kinds of socio-cultural, institutional and legal patterns do they construct and use in order to get calculable conditions in dynamic and competitive cultural, social and economic fields? The article shows that institutional and legal knowledge about intellectual property becomes an essential resource for individual and corporatist actors who strive for social status, economic income, cultural influence and political power. Individuals, interest groups, states and international organizations are involved in discussions and negotiations about the legitimation, form, function, and temporal and territorial range of intellectual property rights. The article gives a short overview of the rise and diffusion of intellectual property rights in Europe and the world and presents then ten theses about the interdependence of central dimensions of modernization, namely propertization, nationalization and globalization. It discusses the role and function of intellectual property rights in the national, international and transnational governance of cultures. Thus, it brings the highly specialized legal research about intellectual property rights back into the disciplinary and interdisciplinary debates about central problems and conflicts of modern cultures and societies. Das Zeitalter des geistigen Eigentums ist gekennzeichnet durch das Vordringen und die Verbreitung eigentumsartiger Institutionen (im Sinne von Regeln) in der Welt des Wissens, der symbolischen Formen und der Medien. Zuständigkeiten und Sonderansprüche für die Nutzung sog. geistiger Werke oder immaterieller Güter sowie die damit eingehenden Herrschafts-, Kooperations- und Austauschbeziehungen werden vermehrt mithilfe der Institution des geistigen Eigentums geregelt. Die Tendenz zur eigentumsartigen Institutionalisierung der Beziehungen in Kultur, Wissenschaft und Medienwirtschaft nimmt seit rund zweihundert Jahren im nationalen wie im globalen Maßstab zyklisch zu. Im Zuge dieser »propertization« oder »Propertisierung«, in deren Verlauf die Regeln und Normen des geistigen Eigentums in immer neue Konstellationen und Kontexte diffundieren, wandeln sich Bedeutung und Funktion des geistigen Eigentums ganz erheblich. Der vorliegende Beitrag diskutiert zunächst zwei grundsätzliche Fragen: Warum und unter welchen Gesichtspunkten unterscheiden moderne Gesellschaften zwischen Gemeinwissen und Sonderwissen? Und welche institutionellen und normativen Muster entwickeln und verwenden sie, um die Nutzung kognitiven Wissens, symbolischer Formen und kultureller Artefakte zu regeln? Daran anschließend wird anhand der langfristigen und globalen Geschichte gezeigt, wie sich Individuen, Interessengruppen, Staaten und internationale Organisationen über Begründungen,
