The European Parliament proposal for a regulation on liability for the operation of artificial intelligence systems

Volume 14 () / Issue 3, pp. 293-308 (16)
Published 04.11.2022

With the proposal for a regulation on liability for the operation of artificial intelligence systems, the European Parliament has given new impetus to the discussion on the introduction of rules concerning AI liability. In addition to strict liability for high-risk AI systems, a presumption of fault is proposed for other AI systems. Operators are designated as responsible parties. The responsibility of manufacturers, on the other hand, is not conclusively clarified. This article presents the most important elements of the proposed regulation and places them in the context of the legal policy discussion.
