In this work, Sophia Sepperer defines clear boundaries to show the parties in a lawsuit when new legal proceedings before domestic courts may be instituted in spite of foreign res judicata. Studying the scope of res judicata in the Member States of the European Jurisdiction and Enforcement Regulation, the author shows the serious differences in the national concepts. She also discusses the effects of a substantively final and absolute judgment on a secondary legal action whose subject matter is identical and which is taken in a different country.
