Forum selection clauses are integral to achieving jurisdictional legal certainty within the EU. At the same time, judgments delivered by a forum derogatum enjoy recognition and enforcement in all member states. Niklas Brueggemann analyses the role of such clauses in the areas of jurisdiction, lis pendens as well as recognition and enforcement from a systematic, political, and comparative perspective. He proposes a new ground for refusal of recognition where a judgment is rendered in violation of a forum selection clause.
