In current legal developments, the personal bond between the parties to a contract is being increasingly loosened and cut. Kai-Oliver Knops reasserts the significance of the personal nature of the contract and, with the help of sociological and economic theories and a comparative law analysis, he develops a comprehensive system for determining this personal nature.
The freedom to choose contractual partners is one of the pillars of private autonomy. In current legal developments, the personal bond between the parties to the contract is being increasingly loosened and cut. This tendency towards the depersonalization of the contract, with its detachment from the social and in particular the personal contexts, has proven to be an ahistorical dissocialization which is contrary to the basic personal principles of Roman and common law. In contrast to this, the author of this study insists on a basic respect for the personal identity of obligations. Kai-Oliver Knops reasserts the significance of the personal nature of the contract and, with the help of sociological and economic theories and a comparative law analysis, he develops a comprehensive system for determining this personal nature.
