Summary
In this work, Thomas M. J. Möllers shows that the concepts of peace, the economy and law alone are no longer an adequate basis for the process of European unification. However the Member States of the E.U. do have enough power and enough in common to enable them to form a European identity beyond the level of legal technicalities and to join forces in coping with the future tasks which will confront them in the 21st century. Against this background, the author presents the first components of a European legislative theory and methodology. This is necessary if the function of the law in European integration is to become a means of regulating the many questions of cooperation in Europe but also of providing clarity in the implementation of European law at the national level. Along with increased openness and the further democratization of European institutions, a European legislative theory and methodology are those elements which are necessary to create a law which will be accepted by the citizens of Europe and will form the basis for a European identity.
