The EU border measures procedure clearly favours the interests of right holders over the interests of the owners of goods seized under its ambit. This work analyzes to what extent the EU border measures procedure is compatible with applicable obligatory provisions in the Agreement on Trade-Related Aspects of Intellectual Property Rights.
