To what extent is the state allowed to encroach on the fundamental rights of a person not charged with a crime in order to solve a crime? Based on the presumption of innocence and the principle of proportionality, Eckstein develops a doctrine of encroachment on fundamental rights which rebalances the relationship between those charged and those not charged with a crime. Eckstein establishes a new basis to protect secrets and confidential information from encroachments on fundamental rights.
