Gabriele Britz reconstructs the general right of personality as an internal partial law which is anchored in the guarantee of free development of one's personality. It is in the service of the individual's achievement of identity, which is obtained by ensuring the individual's own share in the social process of the construction of identity. Its function as a right to self-projection is highly relevant to private law.
Gabriele Britz reconstructs the general right of personality as an internal partial law which is not related to behaviour, a partial law which is anchored in the guarantee of free development of one's personality contained in Article 2 I of the Basic Law. The general right of personality is in the service of the individual's achievement of identity, which is obtained by ensuring the individual's own share in the social process of the construction of identity. Since as a mere protection of prerequisites it is aimed at the individual's own contribution, its protective content should evolve from those threatening situations in which the voluntary nature of the development of personality encounters excessive difficulties. This means that in particular its function as a right to self-projection is highly relevant to private law.
