Summary
Intellectual property is not mentioned explicitly in the German Constitution, but in spite of this it enjoys extensive constitutional protection. This protection has its roots in history, philosophy and human rights, and it is safeguarded by international conventions (in particular the TRIPS Convention). Its contents are determined by various fundamental rights. In his work, the author focuses on the range of the existing regulations regarding intellectual property as far as the content, time and territorial factors are concerned and on the group of persons to whom they apply. In particular he questions the protection of the rights to remuneration by copyright clearance societies and the flat rate determination this entails. Fechner succeeds in proving that there is an autonomous fundamental right of »intellectual property« in the current constitution.
