Fabian Wittreck demonstrates the striking similarities between the cornerstones of the National Socialist legal doctrine (pertaining to issues of race and blood and soil) and classic theories of natural law.
According to a still widely accepted view, legal positivism is to be held responsible for the legal perversions of the Nazi era, and the revival of the theory of natural law after 1945 was an appropriate reaction. Fabian Wittreck demonstrates the striking similarities between the cornerstones of the National Socialist legal doctrine (pertaining to issues of race and blood and soil) and classic theories of natural law. In spite of all its verbal castigation of natural law teachers, Nazi jurisprudence has to be classified as analogous to natural law in its structure and its function.
