Summary
In Germany in particular, but in Austria as well, the consequences of the notary's involvement in legal procedures in which private individuals settle and organize their legal circumstances are increasingly often that the participants make the notary responsible for misplaced expectations that they placed on the contractual transaction in which he was involved. Gabriele Godl examines the individual activities of notaries in both countries, the legal relationship between those concerned and the notary and the legal basis for a liability. Whereas in German law there is a clear legal basis for subsidiarity, this is missing in Austria.
