Summary
The historical legislator intended the liability of employees in tort to favor businesses. However, court attempts to close these recognized liability gaps only ever fail or succeed in an unsatisfactory doctrinal manner. In contrast, Mareike Klappert's study calls for the abolition of § 831 of the German Civil Code and the introduction of a strict liability principle, such as respondeat superior .
