Christoph Henke studies the causes and the mechanisms of the changes in the law and describes the driving forces behind the changes. In doing so, his main concern is why the law is changing. His study is based on the Darwinist approach that the principles of variation and selection apply not only to biology, but to the law as well. It is the author's point of view that the answer to the question of the reasons for the changes in the law are not only of theoretical significance, but can also be of practical assistance in various fields, for example for lawmakers and courts when filling gaps in the law, for assessing the risks of test cases, for those financing litigation, if they have to allow for the risk of a change in a decision by the supreme court, and for companies whose value has to be assessed or whose value has to be reduced.
