Universitätsklinika in öffentlich-rechtlicher oder privatrechtlicher Organisationsform

The authors of the articles in this special issue have two objectives. Using the privatization of the university clinics in Marburg and Gießen as an example, Georg Sandberger shows the requirements and organizational potential for operating a university clinic under private law from the perspective of constitutional law, the law regarding higher education, organizational law, labor law and fiscal law. Using the agreement between the university and the university clinic in North Rhine-Westphalia as an example, Ulf Pallme König does the first detailed study of the incorporation by law of a legal institution which - initially developed for university clinics operated under public law - also has a central function for a university clinic operated under private law, not only for the networking of tasks in research, teaching and health care but also for the solution of conflicts in the overlapping areas.
