Summary
Attempts to promote out-of-court mediation between social service providers and social service recipients are still based on the assumption of rational choice by the parties involved. This fails to recognize negotiation barriers that arise as a result of cognitive biases and strategic behaviour. This study designs a regulation based on behavioral economics and game theory to solve this issue.
