Summary
In this work, the author outlines the transition from the jurisprudence of interests to the jurisprudence of evaluation, using examples and typical developments from German civil law. He bases his study on the figure of the change of paradigms, first introduced into the theory of science by Thomas Kuhn. He offers a detailed discussion of Thomas Kuhn's theory of the process of scientific revolutions and the change of paradigms, the term central to this theory, and applies this to a part of the methodology of German civil law, giving a large number of examples from civil law which can be generalized to encompass other areas as well.
