Summary
The relevant norm in German electoral review law, Article 41 of the Basic Law, does not prescribe a focus on the subsequent scrutiny of an election. Nevertheless, election review procedures always take place following a Bundestag election. Johanna Werpers demonstrates the openness of Article 41 regarding the timing of the review procedure based on electoral errors in admitting party candidates to regional lists.
