Lars Kumkar demonstrates that there is much to recommend establishing a common carrier system in Germany because of specific features of the German electricity supply system (high-quality grid, large markets, stable institutional environment). This would entail deregulating electricity markets and electricity production while subjecting electricity transportation to relatively strict regulation. Regulations should allow sufficient scope for competition to become a discovery process. Further, the author maintains that pool systems are not suitable for Germany because they ignore local information and individual risk preferences. Using comparative institutional analysis, the author demonstrates that the 1998 German Energy Law Amendment is flawed for several reasons.
