The significance of the assignment of claims as a basis for financial transactions is increasing. At the same time, the proportion of foreign claims in companies is on the rise due to the fact that national markets are blending together. This makes it all the more remarkable that the differences in the national assignment laws continue to stand in the way of a smooth dealing with claims. For this reason, the United Nations Convention on the Assignment of Receivables in International Trade has been given the job of creating uniform regulations. Against the backdrop of German assignment law, Elisabeth Schütze analyzes this Convention. In addition to hints to other assignment laws, she deals with the American Uniform Commercial Code and with the UNIDROIT Convention on International Factoring. The author looks at the consequences of a possible ratification of the Convention for Germany and proposes reforms of the national law.
