Freedom of testation is a fundamental principle of all succession laws in Europe and elsewhere. It is, however, everywhere subject to limitations; the civilian compulsory position constitutes the most important one of them. The present book discusses freedom of testation in comparative perspective.
Freedom of testation is a fundamental principle of all succession laws in Europe and elsewhere. It is however subject to limitations, the main one being the so-called right to a compulsory portion. In this volume, the authors discuss freedom of testation from a comparative perspective. They also deal with another dimension of freedom of testation: How can the law make sure that a will constitutes an expression of the testator's right of self-determination?
