Since the Lisbon Treaty took effect, European basic rights have become part of the total body of European Union law. Although it may seem that due to this step the constitutionalization of European basic rights has been completed, these rights have paradoxically lost some of their normativity. This is the theory developed by Jörg Philipp Terhechte using the reforms in the Treaty of Lisbon and the case law of the Federal Constitutional Court.
