Summary
The article examines the provenance of the Federal Constitutional Court's three concepts of art: the material, the formal and the open. Each concept is indebted to classical modernism and fine art, even if this no longer plays a role in their application. The practice of the court has detached itself from the ideals that are still contained in its concepts.
