The failure to correctly label products originating in Israeli settlements in the »Occupied
Palestinian Territory« (OPT) stands in stark contrast to the respective policy with regard to
the Ukrainian territory occupied and annexed by the Russian Federation. While in the latter
case an import stop was imposed immediately following the annexation of Crimea (see I.),
products from the (illegal) Israeli settlements are not even correctly labeled, i.e., it is not
indicated that they originate in the settlements. Yet, the respective labelling obligation
follows from the case law of the European Court of Justice (II. 2.) and also from the 2024
Advisory Opinion of the International Court of Justice (ICJ) on the Israeli policies and practices
in the OPT (II. 1.). In sum, comparing the EU and German policies towards Israel and
the Russian Federation shows clear double standards and it is high time that the former be
aligned with the latter.
