Summary
Terminations usually do not cease the contractual relationship with immediate effect, but at the end of a statutory or mutually agreed notice period. If the terminating party specifies a termination date prior to the expiry of the applicable notice period, it is disputed whether the termination notice is void or takes effect at the later, »correct« date. The inherited legal opinions are all based on a partial misunderstanding of the termination's legal nature. This article shows that generally the termination date does not depend on the intention of the terminating party and that the other party can be sufficiently protected without invalidating the entire termination.
