Summary
This paper examines the formal requirements for entering into a civil marriage in Germany. At present, a civil marriage can only be concluded in a civil ceremony. Couples who have only had a religious ceremony are treated as de facto partners in the eyes of the law. In contrast, many other jurisdictions take a more liberal approach, allowing civil marriage to be performed either in a religious ceremony or before state authorities. The paper assesses whether introducing such a dual system into German law could accelerate social integration and tolerance, or whether changing the prevailing system would create more challenges than advantages.
