Summary
This article examines the fundamental structures of academic freedom in relation to academic teaching. It assesses academic freedom of teaching as a fundamental right with a positive guarantee dimension and positions it within the various functions of fundamental rights. The fundamental right to broadcasting (the prime example of a »serving« freedom) and the fundamental right of parents under the German constitution serve as comparisons. Although the structural similarities between parental rights, freedom of broadcasting, and freedom of teaching are limited, insights can be gained from the comparison. The idea of serving guarantees constructively expresses that freedom of teaching has a structural responsibility that benefits others.
