Freie Verwendung von Abbildungen gemeinfreier Werke? Zur urheberrechtlichen Bewertung von Angeboten gemeinfreier Bilder bei Wikipedia und Wikimedia Commons

The paper deals with the question whether it is permitted under copyright law to offer photographs of public domain works on websites (like Wikipedia or Wikimedia Commons) whose content is uploaded by users for free and should – according to the idea of open access – be usable for everyone without permission. The copyright guidelines published on these websites are in contrast to the prevailing opinion in Germany, according to which at least manually taken photographic reproductions are protected as photographs by Art. 72 of the German Copyright Act (Urheberrechtsgesetz). Only reproductions of other photographs and mere technical reproductions are considered as unprotected.By prohibiting the public to take photographic reproductions and thus limiting the access to the artworks on the one hand, and licensing own photographs through agencies on the other hand, owners of original artworks – primarily museums – have found a way to exclusively exploit the artworks even after the expiry of their original copyright protection.During the 50 year term of protection it is illegal for a third party to make a reproduction available to the public on pages like Wikipedia or Wikimedia Commons as well as to use it in any other commercial way without permission, for example for art books, postcards or posters. Due to the fact that all content on Wikipedia and Wikimedia Commons is completely user generated and not pre-checked, the providers of these websites (s.o.) can, according to current case law in Germany on the Telemedia Act (Telemediengesetz), not be held liable, neither for direct copyright infringement nor for secondary copyright infringement. Users, however, who, trusting the copyright guidelines and the open access nature of Wikipedia and Wikimedia Commons, upload reproductions or download and use the offered reproductions for other commercial purposes may be faced with claims for compensation by the right holders.Since neither these restrictions on the free use of public domain works nor the respective business models of exclusive exploitation by the owners can be reconciled with the concept of public domain, this article suggests that reproductions of preexisting two-dimensional templates should be excluded from photograph protection by means of a teleological reduction of Art. 72 of the German Copyright Act. Der Beitrag beschäftigt sich mit der urheberrechtlichen Zulässigkeit der Verwendung von Abbildungen gemeinfreier Werke in Open Access-Portalen wie Wikipedia oder Wikimedia Commons, deren Inhalte von Nutzern kostenlos eingestellt werden und nach den Vorstellungen der Betreiber für jedermann frei verwendbar sein sollen. Nach Darstellung der Voraussetzungen, nach denen Reproduktionsfotografien zumindest nach herrschender Auffassung einen Lichtbildschutz im Sinne des § 72 UrhG genießen und auch im Rahmen kostenloser Internetangebote nicht ohne Zustimmung des Rechteinhabers angeboten werden dürfen, wird der Frage nachgegangen, welche Verantwortung die Betreiber und Nutzer derartiger Internetangebote für ungenehmigte Verwendungen der Reproduktionsfotografien trifft. Hierbei liegt ein Schwerpunkt in der Darstellung der täterschaftlichen Verantwortung von Providern für so genannten »User-Generated-Content« vor dem Hintergrund der Haftungsprivilegierungen des Telemediengesetzes sowie der Verantwortung im Rahmen der mittelbaren Störerhaftung. An die Klärung der Zuständigkeit deutscher Gerichte und der Geltung des deutschen Urheberrechtsgesetzes für entsprechende Streitfälle schließt sich die Frage an, inwieweit die Gewährung eines Leistungsschutzrechtes für Reproduktionsfotografien zu einem Wertungswiderspruch im Hinblick auf den Ablauf der urheberrechtlichen Schutzfrist am Originalkunstwerk oder sogar zu einer faktischen Schutzrechtsverlängerung führt.
