Summary
The legitimacy of church and state action is based on different starting points. Church action is based on the mandate of the church and bound by scripture and confession. State action is legitimised democratically and thus primarily procedurally. However, neither the state can dispense with material legitimacy, nor can the church dispense with procedural implementation. It is an oversimplification to say that the church is democratically constituted.
