Hochschullehrer unter Verdacht – vermeintliche Kollisionen zwischen Wissenschaftsfreiheit und Dienstrecht

Do universities offer a safe and trusting environment for their students and employees? This question is currently being debated in the state parliament of North Rhine-Westphalia. For years, universities have been making efforts and investing resources to counteract disruptive behavior that violates their duties using the instruments available under civil service law. This is the subject of the following article. The article analyzes the regulatory structures of a reform that deliberately set out to set a nationwide example and questions the necessity and appropriateness of the changes, also with regard to the applicable law and experience with it.
