Schnittstellen aus medienrechtlicher Perspektive

Publizistischen Medien kommt eine Doppelfunktion zu – als Informations- und Kulturgut einerseits und als Wirtschaftsgut andererseits. Die aus dieser Dichotomie resultierenden Schnittstellen haben in jüngster Zeit für ganz unterschiedliche Sachverhalte Relevanz erlangt und die Diskussion um das Neben- bzw. Miteinander des Medien- und Wettbewerbsrechts neu entfacht. Vor diesem Hintergrund beleuchtet der nachfolgende Beitrag zunächst das grundsätzliche Verhältnis beider Rechtsbereiche zueinander und zeigt auf, welches Rechtsgebiet für welchen Sachbereich zuständig bzw. leistungsfähig ist. Diese eher generellen Überlegungen werden sodann auf zwei konkrete Anwendungsbereiche heruntergebrochen: die Vielfaltssicherung mit den Mitteln des Medienrechts (»publizistische Vielfaltssicherung«) und die Vielfaltssicherung mit den Mitteln des Wettbewerbsrechts (»ökonomische Vielfaltssicherung«). Journalistic media have a dual function – as informational and cultural asset on the one hand and as economic asset on the other hand. The interfaces resulting from this dichotomy gained new relevance in different circumstances recently and reopened a discussion on the coexistence of media law and competition law. Against this background, the following article first illustrates the basic relation of both areas of law. These more general considerations will then be broken down to two specific topics: the protection of pluralism by means of media law (»journalistic protection of media pluralism«) and the protection of pluralism by means of competition law (»economic protection of media pluralism«).By doing so, the article comes to the conclusion that competition law is not sufficient to safeguard journalistic diversity and equal communication opportunities. Media law and competition law have been stipulated for different purposes and therefore can lead to different results. Currently, the larger regulatory deficits exist in the field of media law and not in the field of competition law. Especially, the media concentration law has to be adjusted to media convergence processes and has to be developed to a »positive« pluralism protection law. By contrast, the enrichment of the competition law by regulatory elements ensuring journalistic pluralism should be considered with scepticism. Instead, consideration should be given to the entrusting models in Art. 106 (2) TFEU.
