Summary

For most Member States, including Germany, a key innovation of the EU's Corporate
Sustainability Due Diligence Directive, adopted in June 2024, is that the obligations set
out in the Directive will be enforced not only through administrative orders and fines,
but also through civil liability (Art. 29 CSDDD). This article evaluates the benefits and
drawbacks of private enforcement in this context, and analyses the core elements of
the Directive's civil liability regime.
