Über die Zuständigkeit kirchlicher Verwaltungsgerichte

A recent decision by the ecclesiastical court of justice prompts an examination of the relationship between the law of the member churches (specifically the Nordkirche) and the law of the EKD. The issue at hand concerns the jurisdiction of the administrative courts. The court's thesis - that the law of the Nordkirche (based on the principle of enumeration) is superseded by the law of the EKD (based on a general clause) - is questionable. Likewise, the assumption that an appeal is possible against judgments of a constitutional court is open to doubt.
