The EU harmonization of the reproduction right (Art. 2 InfoSoc Directive) does not extend to the separate adaptation right (Art. 12 Berne Convention, § 23 German Copyright Act). Therefore, it is for the Member States to define the delimitation of the adaptation right and free use beyond the scope of copyright.
