Allgemeine Rechtslehre als juristische Strukturtheorie

The general theory of the law at the end of the 19th century was dedicated to the search for standard basic legal terms. Its goal was a universal legal technique for dealing with legal material. Andreas Funke distinguishes between the tasks of this general theory of law and disciplines such as the philosophy of law and the sociology of law and determines their function in legal dogmatics. He also analyzes the methods of the general theory of law and each of their epistemological terms of reference. He concludes with a critical tribute to the basic content of the statements of the general theory of the law, and focuses on the concept of the validity of legal norms as well as the figure of the legal relation which is expressed in a legal norm.
