Allgemeine Vertragsgrundregeln als Vertragsstatut

Considering the practical aspects of a choice-of-law clause in favor of non-national norms such as the UNIDROIT Principles of International Commercial Contracts, Sven Schilf stresses the necessity of a clear definition of the term »law« which can be used as a basis for various instruments in private international law and international arbitration requiring a choice of law. The author develops a new understanding of the law, allowing the qualification of non-national norms as a positive law according to the conflict of law rules applied by government courts. This new understanding also enables the solution of many practical questions related to the application of non-national norms. The arguments presented here are based on classic civil law considerations and also on new developments in Anglo-American law.
