According to the German Civil Code, a contracting party may demand compensation for damages on the basis of either contractual or delictual claims. In France however, the delictual remedy between two contracting parties is not possible. In this work, the author discusses the question of which rule is applicable if the law of more than one country is to be applied to a certain case with links to both countries.
