With the European small claims procedure, European lawmakers have for the first time created standard rules for contentious civil proceedings. Arno Brokamp describes the individual articles and gives practical advice on how the numerous questions and discrepancies in regard to the procedure, which takes effect as of 2009, can be managed. Since the procedure has only been regulated cursorily, in many places it will have to be dealt with in an interaction with other regulations and the subsidiary German procedural law. The author also focuses on the strained relationship between the attempt at simplification and the preservation of basic judicial rights. The book was awarded a prize by the Munich Bar Association.
