Gregor Kirchhof investigates the constitutional limitations of interstate cooperation between Federal States, taking the Gambling Commission (Glücksspielkollegium) as an example. According to the author, the lack of effective control of the commission violates the democracy principle. Exemptions to this requirement, such as can be found in the areas of broadcasting law, protection of media for minors or on the basis of a transnationalc cooperation between Federal States, do not apply. Basic law therefore demands comprehensive reform of the gambling system.
