Das IPR des geistigen Eigentums in der VR China

Intellectual property is a corner stone for any investor making his way into China. Due to the territoriality of intellectual property, patents, trade marks and copyright are governed by Chinese law. In the case of cross-border actions, the choice of law comes into play if international conventions do not provide the rules for the transaction. The choice of law made by the parties may not contravene the mandatory provisions of Chinese law. If the parties do not choose, the principle of closest connection must be applied. In this book, the author looks into the possibilities and limits of the choice of law and the problems related to it viewed from the perspective of German law.
