Das neue internationale Privatrecht von Venezuela

Nicole Monleón describes the current state of development of Venezuelan private international law. She deals with the historical background of Venezuelan law. The Venezuelan private international system was shaped by two influences: the principle of territorialism and the principle of personalism. The antagonism between these two principles characterized Venezuelan private international law until it was overcome with the enacting of the 1998 Act on private international law ( Ley de Derecho Internacional Privado - LDIP). The LDIP is an all-embracing Private International Law regulation. Both the conflict of law rules and the procedural aspects of private international law have been given a place in the Act. The LDIP establishes the domicile as the connecting factor and defines it as the habitual residence. Thus the author also focuses on the interpretation of the term domicile.
