Summary
Robert Leo Bergmann looks at how contracts with a huge imbalance between performance and counter-performance should be dealt with. Beginning with the assumption that the current legal consequences in German law do not provide a solution to the problem that is in the interests of the parties, a comparative analysis then shows that German law's total nullity is isolated in Europe. But could the solution arrived at be integrated into the existing legal system?
