Chichou Yeh deals with the compensation for the damages caused by a traffic accident in Germany and Taiwan. He shows that a radical reform in which liability is replaced by insurance is not to be recommended for Germany because of the social precautions, the protection provided by the liability law and the compulsory insurance law, the financial burden and the effects on the level of performance. In Taiwan, there was a need for a no-fault insurance because of the development of the liability and social security laws, but this no longer fits in with the entire legal system. Thus the next reform should be along the lines of the objectification of liability and the combination of the compulsory insurance law in Taiwan with liability law.
