Benedikt Flöter analyses legal protection of intellectual property prior to the introduction of statutory protection for such intangible assets. American judiciary-led legislation in particular draws on economic justifications for protection that forms a complex system for balancing competing interests. On this basis, the author suggests an Unfair Competition Law-based approach to the protection of investment in intangible assets that have not yet been granted statutory protection.
