Summary
The rule of cover and assumption as a means of protection of real rights forms one of the fundamental principles of the German law on forced public sales of land: Rights which have priority to the right of creditor prosecuting are not touched by the sale, ordered and executed by the court. The study shows how this legal maxim, which is important for economy and credit system, found its way into the law, the history of which is placed in the last third of the 19th century.
