Summary
This book is a comparative and historical study of statutory interpretation in various European legal systems. The author examines the interpretative practice of the German, French and English courts and of the European Court of Justice. The frequently maintained view that English and continental methods of statutory interpretation differ fundamentally is challenged on the basis of a thorough analysis of hundreds of cases. It is shown that there is a common core of European principles of statutory interpretation with a long tradition reaching back to the 13th century and indeed to classical Roman law. This study is a valuable tool for comparative lawyers, legal historians, Community lawyers and students and lecturers of jurisprudence alike.
