Summary
Due to the recent EC directive on injunctions for the protection of consumer interests, European Community Member States are under pressure to adjust their law on legal action taken by associations. In Germany, the question arises as to whether to adhere simply to the minimum standard set by the directive or to adopt a broader approach leading to more wide-ranging changes to be included in its Code of Civil Procedure. This book offers a thorough study of the law of class actions and of legal actions taken by associations in various legal systems, including their economic background. It concludes with 13 proposals on how to change the German law.
