Katharina Ernicke investigates the development of the so-called triple damage calculation, which allows the amount of damages to be calculated either according to the actual pecuniary loss or, alternatively, according to an appropriate licence fee or the infringer's profit. She examines the origin of the triple damage calculation in German copyright law, its expansion to the various fields of intellectual property law and its permanent establishment in German law in the first half of the twentieth century.
