Die Methodik des EuGH im Urheberrecht

Copyright is nowadays dominated by European law. Directive 2001/29/EC harmonised a number of exploitation rights and the CJEU increasingly lends concrete form to undefined legal concepts by way of so-called autonomous interpretation. This has implications for the right of communication to the public and the making available right, the definition of work and for the exception allowing private copying. Verena Roder systematises the court's copyright case law and contributes to the European methodology by examining its reasoning on both the interpretation canons and exploration of precedents. The author highlights the significance of international treaties and their direct impact on the interpretation of European secondary law.
